Aggravated Drug Trafficking

The jury found the Client guilty of Misdemeanor Assault and asked he be sentenced to 90 days in the county jail, time served (Client had served the 90 days awaiting trial).

Client was charged in Federal Court with Conspiracy to Traffic Illegal Narcotics (Methamphetamine). The Client had over 15 prior felony convictions, mostly for drug related offenses. The Client was heavily involved in the criminal enterprise, and the Government’s evidence appeared overwhelming. Attorney McLawhorn, after extensive research and review of the evidence, was able to have the Client’s guideline range reduced from potentially 15 years in the Federal Bureau of Prisons to 6-9 years. At the Client’s final sentencing, the Court sentenced the Client to 5 years with credit for time served, thus sentencing the Client below the advisory guideline range.

Inappropriate Touching of a Child

Case Closed/No Charges Filed -

Client was being investigated for inappropriate touching of a child. Attorney McLawhorn was retained during the investigative process and prior to the filing of any criminal charges. Attorney McLawhorn was able to open a dialogue between the investigative agency and the prosecuting agency. After several months, the case was closed, and no charges were filed.

Kidnapping, Drug Possession, Burglary, Robbery

Client was charged with count 1: Kidnapping, count 2: Possession of Methamphetamine within 1,000 feet of a School or Park, count 3: Possession of Marijuana within 1,000 feet of a School or Park, count 4: Burglary in the First Degree, count 5: Robbery in the Second Degree and count 6: Unlawful Possession of Drug Paraphernalia. The Client was charged in a small town and small county. After Attorney McLawhorn investigated the facts surrounding the charges, counts 1,2,4,5 and 6 were dismissed and the Client was granted a deferred sentence on count 3, thus allowing him to avoid a felony conviction, jail time, prison time and have all counts dismissed.

Lewd Molestation of a Child

Client was charged with Lewd Molestation of a Child. The Client maintained his innocence. The Client was incarcerated in the county jail. Attorney McLawhorn engaged in an extensive investigation. Attorney McLawhorn conducted his own interviews and investigated the facts of the allegation. Attorney McLawhorn took his findings to the local prosecuting agency, and the Client’s case was dismissed, allowing him to go home.

Misdemeanor Manslaughter

Minimum Sentence -

Client was charged with Misdemeanor Manslaughter for causing the death of another while driving under the influence of alcohol. In Oklahoma, this charge carries a minimum of 4 years up to life in the Oklahoma Department of Corrections (with no prior felony convictions). This case occurred in a small county, where a jury trial had not been conducted in nearly 20 years. The facts were bad. The Client had prior convictions for driving under the influence and had confessed to drinking at the time of the offense. The Government sought a sentence of 25 years in the Oklahoma Department of Corrections. Attorney McLawhorn, after multiple consultations with the Client, tried the case before a jury. At the end of the trial, the Client was found guilty, but sentenced to the minimum of 4 years in the Oklahoma Department of Corrections. A win under the facts of such a horrendous case.

Possession of a Firearm

Dismissed -

Client was charged with Possession of a Firearm after formal juvenile adjudication, a felony offense. The Client was incarcerated in the county jail. A preliminary hearing was held, and Attorney McLawhorn’s oral motion to dismiss the case was granted. The Client’s case was dismissed, and he was released.
